The European Parliament voted in their second reading of INSPIRE to support the rapporteur’s amendments in favour of free public “view” of geodata, and against the intellectual property get-out clauses added by the Council of Ministers.

Because the Council made no effort to reach an agreement with Parliament between the ENVI vote and the second reading in the Parliament, INSPIRE now goes to a “conciliation” process before a third reading in Parliament.

Open Letter Third Reading is the letter that Public Geodata is sending to all 25 Ministers in the Council. INSPIRE should be enabling the exchange of geodata. Does each Minister support amendments in favour of better access and less restriction going into conciliation? If not, can the Minister explain why in a national parliament setting?

The Council is made up of Ministers in each European national government who are responsible for environment policy. They accept policy advice from National Mapping Agencies in each country; they don’t get to hear many other voices!

What to ask?

  • Does your Minister support the Parliament’s Amendment 21 (restoring the right of the public to view public geodata free of cost)?
  • Does your Minister support the Parliament’s Amendment 27 (exempting geodata from publication due to “intellectual property rights”)?
  • If not, why not?

Amendment 21 restores the right of the public to view, free of cost, state-collected geographic data

Council
=======

1.  Member States shall ensure that:
(a) the services referred to in point (a) of Article 11(1) are available
to the public free of charge;

(b) the services referred to in point (b) of Article 11(1) are, as a
rule, available to the public free of charge. However, in cases where
charges and/or licences are an essential precondition for maintaining
the spatial data sets and services or for fulfilling the requirements of
already existing international spatial data infrastructure in a
sustainable way, Member States may apply charges and/or licences either
to the person providing the service to the public, or, where the service
provider chooses, to the public itself.

Parliament
==========

1.  Member States shall ensure that the services referred to in points
(a) and (b) of Article 11(1) are available to the public free of charge.

Support for Amendment 27?

Amendment 27 deletes the copyright get-out clause added by the Council which states This Article does not affect the existence or ownership of public sector authorities’ intellectual property rights.
